Legal Awareness Toolkit and Standard Operating Procedure SOP

It has been completed and published in English and Nepali language.  These document is useful in order to use as reference materials in the process of identifying persons in Harawa Charuwa and their rescue, rehabilitation and reintegration.  In addition, we have incorporated the national and international legal provisions related to their rights, remedies and complain mechanism as well. We believe that this Toolkit will serve in fighting the menace of Harawa Charuwa and other forms of bonded labour in Nepal.

Sati Pratha

J4A conducted research resulting in a document about the abolition of Sati Pratha in Nepal. The main objective of this research to take the necessary steps to establish Ashar 25 as a national day for women’s liberation, as on this date Ashar 25 1977BS “Sati Pratha” was abolished.  J4A published research report on 25 Ashar 2069 (BS)  and organized a interaction program in collaboration with the National Women Commission. The report highlighted that Nepal should not forget its good initiation in ending the violence against women.

Training Manual on Role of Health Service Providers to Respond to Sexual and Gender Based Violence

The training manual on the Role of Health Service Providers to Response to SGBV was prepared to conduct three days training for health service providers. This training manual can be used as resource materials for capacity building of health service providers. It will help them provide services  from a rights based approach,  and behave in positive, supportive ways to victims who visit a hospital. In addition, the crucial role of health service providers to ensure access to justice for victims/survivors of SGBV were incorporated in the materials. The training materials were widely disseminated.

GESI Responsive Reconstruction Monitoring Framework and Guideline

Monitoring Framework and guideline for the Implementation of Gender Equality and Social Inclusion in the Post-Earthquake Reconstruction and Rehabilitation was prepared and distributed to concerned agencies. The Guideline has been prepared in Nepali language.

Policy Briefs and Advocacy Leaflets

J4A has prepared and published the following advocacy leaflets with the aim of submission to the concern government authorities post- earthquake. The advocacy leaflets were disseminated both at the central and district level sharing workshops  as well as distributed to stakeholders.

  • Identification of Earthquake Victims and Reconstruction Context, and
  • Post-Earthquake Violence against Women, Problem and Protection.
  • Women’s Participation in the Context of Post-Earthquake Reconstruction.
  • Access of Women to Housing Grants for the Reconstruction of Private Houses.

Media Research on Recommendations for implementing Domestic Violence (Offence and Punishment) Act 2009

J4A has conducted media research on news of incidents related to domestic violence against women. The objective of this research was to find the diversity of violence and to submit recommendations to concerned government authorities as they should take necessary and effective action for the better implementation of existing laws. Research report was published on 2013 has been disseminated to concerned government authorities.

Implementation Status of Judgments Related to Reproductive Health Rights

J4A has conducted a study to document the implementation status of the judgments delivered by the Supreme Court of Nepal that are related to reproductive health rights and justice.  This research is conducted in collaboration with the National Women Commission (NWC) and disseminated it to all concerned stakeholders through NWC on 2012.

Status and Challenges of State Party Case

The right to justice is an inherent content of human rights. One of the important obligations of the state is to ensure the right to justice; State parties are obliged to enforce the right to justice effectively, which is stated in many international human rights instruments of which Nepal is a party. Many cases related to gender based violence, especially rape and  human trafficking are not being successfully brought to justice. Victims are reluctant to go to court for justice.  J4A, in collaboration with the government attorney, has conducted a study on the status and challenges of state party case in Nepal. The goal is to determine the causes and consequences of the failure of prosecute, and to prepare recommendations to improve the investigation and prosecution systems. Research was also focused on finding the trends of public prosecutors regarding their attempts in referring constitutional value, universal international human rights instruments and judicial decisions. The report from the research is instrumental to improve prosecution and investigation of the criminal case.  The report was published on 2014 were disseminated to all concerned stakeholders.

Speak Up to Stop Gender Based Violence

J4A published  training materials and a training manual on 2011to conduct training for women and male groups with an aim of creating awareness about the legal basis of eliminating gender based violence.
